Labuan work permit is issued to the director of Labuan company. In Malaysia, the government have a very flexible policy for foreign workers conducting commercial transactions utilizing Labuan company, issuing work permit (hereinafter referred to as “work permit”) for directors and expatriates allowed to stay in Malaysia (*renewable every 2 years, renewal requires submission of application 3 months before expiration date). Apart from the directors, their dependents (spouses and children below 21 years) are also granted a work permit. They can stay in Labuan or in mainland Malaysia. Staying in Malaysia mainland (e.g.: Kuala Lumpur, Johor Bahru, etc.) is permitted not only within Labuan Island.

• Submission of Application for Labuan Work Permit

When applying for a work permit after incorporating a Labuan company, you have to prepare and sign several documents and courier them to your consultants in Malaysia. Once your work permit is approved, you will have to visit Labuan Immigration and pay the relevant fee to complete the procedure. Other points to take note, Labuan Immigration issues work permits only from Tuesdays through Thursdays. So, you will have to plan your travel accordingly. The meeting with immigration in Labuan only applicable for first time application.

• Recent Changes on Labuan work permit new application

There are four major changes that happened in the Labuan work permit that must be known:

1. The minimum monthly salary to declare is RM 10,000
2. Business plan including the following, the objectives of the Business, product and service offered, Target markets, Organization chart, minimum 3 years financial projections.
3. The Labuan company must need to have a physical office address before company procced for work permit, this address must have to be different from registered secretary address.
4. For each expatriate is required to submit two reference letters of good standing depending on their own profile. Point to take not that this letter of good conduct is not from Local Police department.

 Preparation of Checklist

The following documents should be ready before application:

• Passport size photographs (white background) – 4 Nos.
• A true copy of latest passport certified by Notary Public
• A true copy of your highest qualification (certified by your country’s Embassy/Notary Public
• Your Labuan company’s business plan (with the financial projection for the next 3 years)
• Personal Resume & Academic certificates
• Original copy of Employment Contract
• Tax Reference number (Labuan entity, employer, employee)
• Details of operational office (Tenancy agreement)
• Form DP10/DP11

You should sign on all pages of the entire set of documents and courier them to your consultant along with 2 copies each of Employment Letter, Letter of Undertaking, and Statutory Declaration. Further, the date field must be left blank. The Labuan Financial Services Authority will enter the date.

As the director of the company, you are required to have an employment agreement with the Labuan Company prior to applying for a work permit. Moreover, your monthly salary income must be at least RM 10,000 as per the appointment letter.

Timeline for Labuan Immigration Approval:

It takes approximately three weeks to a month from the date of submission of the application to obtain the Labuan Immigration Department’s approval. A visit to the Immigration Department in Labuan is a must, after you receive the approval, for the issuance of a work permit visa.
